These Terms of Use govern your use of this website, our products and our services which are owned, operated and provided by Global Heart Hub. Please read our terms and conditions carefully before using our services. By accessing and browsing this website, you accept, without limitation or qualification, these Terms and Conditions and acknowledge that any other agreements regarding the use of this website between you and Global Heart Hub are superseded and of no force or effect.

Information on this website is provided by Global Heart Hub and is intended for general information purposes only. Should you have a medical condition, promptly see your own medical doctor or health care provider. We do not offer personalised medical diagnosis or patient-specific treatment advice.

Registration Details

We may at times require that you register and/or set up an account to use certain portions of our website. In order to do so, you may be provided, or required to choose, a password, user ID, and/or other registration information, including, but not limited to, personal information (collectively, “Registration Information”). You agree and represent that all Registration Information provided by you is accurate and up-to-date. If any of your Registration Information changes, you must update it by using the appropriate update mechanism on our website, if available. If Global Heart Hub believes that the Registration Information you provide is not correct, current, or complete, Global Heart Hub reserves the right to refuse you access to its Services. Your use of the registered Services is a representation to Global Heart Hub that you are at least eighteen (18) years of age or have parental or guardian consent. If you are accessing our Services on behalf of a body corporate (which includes a company or other organization with legal personality wherever or however incorporated), a partnership, a trust, a joint venture or an incorporated association or organization (the “Company”), by accessing our Services, that Company accepts these terms and you warrant that you are authorised to accept these terms on behalf of such Company.

Restrictions On Use

You may use our Services for your own personal use, and where access is granted, for commercial use. You may not use our Services for any other purpose without Global Heart Hub’s express prior written consent. For example, if you are not a recognised Affiliate or partner of the Global Heart Hub, you may not (and may not authorise any other party to) co brand our Services without the express prior written permission of an authorised representative of Global Heart Hub. For purposes of these Terms of Use, “co branding” means to display any name, logo, trade-mark, or other means of attribution or identification of any party in such a manner as is reasonably likely to give a user the impression that such other party has the right to display, publish, or distribute our Services or which may confuse a user as the nature of the relationship between any party and Global Heart Hub.

User Content

When you access certain features on our Site that allow you to post and communicate with other users, we urge you not to share any personal information, confidential information or any other information that you would not want to share with the general public.

Proprietary Information

The entire contents of the Site, including without limitation, all names, designs, graphics, images, illustrations, photographs, artwork, video, audio, software, code, data, text, displays, the Site’s “look and feel”, logos, slogans, trade-marks, trade names, service marks, domain names, and the design, selection, arrangement and presentation of the Site as a collective work and/or compilation is protected under Irish copyright and is owned by Global Heart Hub or has been licensed to Global Heart Hub. User Content is owned by the person who posted the information on the Site or the third party licensor, as the case may be.

By using our Services, Global Heart Hub may provide you with documents, information and resources (“Documentation”) owned by Global Heart Hub or licensed to Global Heart Hub which are protected under copyright, trademark, patent and other intellectual property rights. All content in the Documentation, including the collection, arrangement, and assembly of such content, is the exclusive property of Global Heart Hub or licensed to Global Heart Hub. You are granted a personal, limited, revocable, non-transferable and non-exclusive license to access, read and download the Documentation located on the Site for personal, non-commercial and not-for-profit use only. You may print pages from the Site for your personal, non-commercial use only, provided that you do not modify any of the Documentation and you do not remove or alter any visible or non-visible identification, marks, notices, disclaimers or other Global Heart Hub Content.

Except as described in these Terms of Use, you may not copy, sell, license, transfer, publish, reproduce, modify, display, reverse engineer, decompile, disassemble, adapt, translate, transmit, arrange, bundle, sublicense, export, merge, loan, rent, lease, assign, share, outsource, host, distribute in anyway, prepare derivative works based on, re-post, make available to any person or otherwise use, either directly or indirectly, any of the Documentation or content in the Documentation, in whole or in part, in an form or by any means whatsoever, be they physical, electronic or otherwise, without the prior written consent of Global Heart Hub.

Our Services contain hyperlinks to other sites that are not maintained by, or related to, Global Heart Hub. Hyperlinks to such sites are provided solely as a convenience to you and do not imply any endorsement by Global Heart Hub of, any affiliation with or endorsement by the owner of the linked site. Use of our Services and Communication Guidelines

Global Heart Hub expects that you will access and use our Services in a responsible manner in accordance with applicable laws and treat all users of the Site (the “Users”) lawfully and respectfully when posting User Content and interacting with Users through the Site. By using our Services, you may also have the opportunity to engage in dialogue with Global Heart Hub representatives (i.e. employees and volunteers) by email, phone, at the Global Heart Hub office or at Global Heart Hub events. Any questions, comments and other information (collectively, “Information”) communicated to Global Heart Hub representatives, whether by email, phone or in-person and any User Content posted on the Site must not be obscene, illegal, threatening, embarrassing, defamatory, libellous, harmful, abusive, harassing, tortuous, homophobic, sexist, vulgar, obscene, hateful or racially, ethically or otherwise objectionable, an invasion of privacy, an infringement of third party intellectual property or privacy rights, or otherwise injurious to third parties.

You further agree that you shall use our Services for lawful purposes only and represent and warrant that you will not use our Services to:

(i) E-mail, post, provide, communicate or otherwise transmit (“Transmit”) any Information or User Content that you do not have a right to Transmit under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(v) Transmit any Information or User Content that is intimate, private or that you would not want the public to view or have access to;
(vi) Transmit any Information or User Content that contains the personal health information of other identifiable individuals without their express consent;
(vii) Transmit any health card information, including the number, the version code or both;
(viii) Post any User Content that associates Global Heart Hub with any company, product or service that is contrary to any Global Heart Hub policies or may harm the reputation of Global Heart Hub or any Global Heart Hub programs;
(ix) Impersonate any person or entity or misrepresent your affiliation with any other person or entity, including without limitation, using a false email address or misleading Global Heart Hub as to your identity;
(x) Transmit any Information or User Content that violates the legal rights of others or that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use and our Privacy Policy;
(xi) Transmit any unsolicited or unauthorised advertising, branding, promotional materials, commercial solicitation, political campaigning, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
(xii) Upload, e-mail, send via the Internet, provide us with, or otherwise transmit any software viruses or any other computer code, files or programs designed to interrupt, destroy, alter, or limit the functionality of any computer software or hardware or telecommunications equipment or that imposes an unreasonable or disproportionately large load on the Site’s infrastructure or limits the functionality of any Global Heart Hub or third party computer hardware, software, networks, or hardware or telecommunications equipment;
(xiii) Interfere or attempt to interfere with or disrupt our Services including but not limited to our servers or networks connected to our Site, including attempting to interfere with the access of any other user, host or network, including without limitation, overloading, initiating, propagating, participating, directing or attempting any “denial of service” attacks, “spamming”, “crashing”, “flooding” or “mail-bombing” our Site or disobeying any requirements, procedures, policies or regulations of networks connected to our Services;
(xiv) Direct bots, spiders, crawlers, avatars, intelligent agents or any other automated process at Global Heart Hub’s computer systems or otherwise, create unreasonable load upon any of Global Heart Hub’s computer hardware, network, storage, input/output or electronic control devices;
(xv) Remove any proprietary notices or labels, or any promotional or advertising material, from our Services;
(xvi) Use our Services for any public or commercial purposes, without the express prior written permission of Global Heart Hub;
(xvii) Intentionally or unintentionally violate any applicable local, provincial, national or international law, rule or regulation applicable in connection with our Services;
(xviii) Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any of our Services, including but not limited to any portion of our Site; or
(xix) Rebroadcast, retransmit or redistribute any Global Heart Hub Content or Documentation without the express prior written permission of Global Heart Hub.

These Terms of Use and any other legal notices, policies and guidelines of Global Heart Hub linked to these Terms of Use constitute the entire agreement between you and Global Heart Hub relating to your use of our Services and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter and the Terms of Use may not be amended or modified except in writing or by making such amendments or modifications available on our Site.
